I came across this news about the fastest murder trial in India so far! All over in 10 days!

‘A district court made legal history on Saturday by convicting a man with murdering his wife within 10 days of framing charges, and in just three hearings

On Saturday, Chandigarh additional district and sessions judge Raj Rahul Garg found Sunil Kumar guilty of brutally killing his wife, Kiran, on February 17, 2009. The accused was convicted solely on the basis of his eight-year-old son’s statement. The quantum of punishment will be pronounced on Monday

Charges were framed within 70 days of the crime and the verdict came 10 days after the chargesheet was filed.
“It is a ray of hope for thousands of victims and a warning for those who exploit the loopholes in criminal justice system,” said criminal lawyer N K Nanda. ‘

This certainly came as a ray of hope , especially in the middle of election coverage where all people seem to be talking about is the number game.. I do hope that we get to see more of these sorts of judgements.. Kasab’s trial would have been a nice way to start…

  1. This is a really heartening development. We are all excited because it often takes decades to decide such cases. I wonder whether the judge was looking consciuosly to set a record or had been “speeded up” suitably by one of the parties! In India everything is possible.

    Yes, Vinod, Anything is possible 🙂 We have become so cynical that even with something positive, we tend to look to see , if it is really so 🙂 Lets just hope that it is a landmark case and not a hurried up case to bury something else..

  4. 8 year old’s statement?? phew that is scary!! If only they showed ths enth in Kasab’s case as well!! they are worried about providing books, newspaper & non-veg to that ___ !! Heights I should say!

    Yes, an 8 yr old’s statement.. Lets just hope that it was a correct decsion and not any politically motivated one.. Yes, Kasab’s case is becoming a bigger drama everyday.. Funny, isn’t it- for something that should have been a open and shut case…

  5. This is quite fantastic, Smitha! And very heartening if justice was really done. I hope it was.(I only say this because he was convicted on the testimony of a child.)

    Most cases drag on because the accused appeal to higher courts after being convicted and sentenced in lower courts. (like Sunjay Dutt.)

    This man has been convicted in the District Court. I don’t know whether he has the means to appeal to the High Court and if needed, further.

    Yes, Manju, Totally agree with everything you say.. I certainly hope that justice was done.. And as you say – it might drag in the higher courts.. I do wish that this would be the norm as against the exception..

  9. Thanks for posting it.. ray of hope it is… when there is clear evidence, then a faster trial is what is needed. The same goes for Kasab too.. we don’t want him feasting on biriyani’s until another hijack drama. Kasab is a test of patience for all Indians and frankly speaking, this patience cannot hold further.

    Yes Asha, Kasab’s case is clearly a test of patience for all of us.. Lets see what happens there – I do not have much hope though.. given the way it is progressing..

  14. Good to hear this news. Normally everything takes years to decide upon a case, that too murder case. When the case runs for a longer time, the culprits get time to look for some loopholes and turn the case. If the judge is confident about the crime of the accused, he should not postpone the judgement. Hope others follow this method.

    May be lady’s parent have used their so called influences to get this solved asap…or courtsey to election …dont know…

    but if its genuine then india is really progressing.

  20. i just want to celebrate — because it is done and over — whatever the judgement ! if more lawyers were employed and judges came on time and left on time ( and not taking those chai breaks and siesta lunch breaks — india would not have stood still in time with respect to many many things..

    so lets celebrate — i’ll get icecream and ..

  22. This could be the first step towards improving our criminal justice system. It might give some hope to the thousands of Indians languishing in jails across India because of the slow speed of our judicial system.

  24. imagine if all cases were cleared so fast? its not gonna happen, we know it but imagine.. the though itself feels so good…

    lets hope this sets the trend for other cases..they may not get judgements that fast..but hopefully they will speed it up a bit n not keep people waiting for years together..

  28. Its easy for an easy trial in an open and shut case. But when hardened criminals or someone who has planned the crime well is concerned, this might take a long time. Anyway, such exceptions in our justice system is exceptional. Hope things change for the better soon.

    Even if they are open-and-shut case, our trials dnt take place. Undertrails are worst affected in thsi country. 😦

    Yes, it just reflects on our system when we are so happy to see them doing things – which is their job anyways 🙂 But yes, I do hope that this becomes the norm… It will certainly encourage more people to approach the law..

  35. I really hope that this sets a trend..hai na? Though knowing us Indians that is it seems kinda hopeless or atleasta very long drawn process IF it ever does change that is…

    you know what really wish for?that the Kasab case does not go the afzal guru way.. coz that would be a huge tragedy and blunder… 😦 as it is the media is already getting all hyper about Kasab…
    I wish people would stop being so hypocritical in our country…

    we need more such judgements and Kasab’s case should be dealt with in the saem manner..as quickly as possible

    Indyeah – This case just shows that our judiciary can be efficient and quick – if they want to.. For some reason (mainly political) trials have a way of getting delayed for years.. Kasab’s trial should have been very quick.. and you know what really amazes me is that we have no protocol to try these kinds of criminals.. There should be fast track courts for such cases.. It will be a real tragedy if it goes the Afzal guru way..
